Kochi: Kerala High Court today refused to issue a stay order on the FIR registered against actor Aju Varghese for revealing the name of the actress, who was sexually abused in a vehicle recently, on social media.
Stating that the court can’t interfere into the police investigation, the HC said the case will not end though he reached an agreement with the victim. Meanwhile, the court issued a notice to the complainant, Kalamassery native Gireesh Babu, seeking his stance in the case.
Aju Varghese had approached the HC demanding the dismissal of the FIR filed against him in the case.
He also submitted the affidavit of the actress, which states that she has no objection in cancelling the FIR against him. The actress also mentioned that Aju is her friend and he revealed her name not with a malicious intent.
It may be recalled that the police charged a case against the actor as he mentioned the name of the actress in a Facebook message supporting actor Dileep, who was arrested in connection with the case.
Later Aju expressed his regret and apologized for using the victim’s name in the FB post. During the interrogation, the police also seized his cellphone.
On July 3, an FIR was filed against Aju Varghese and a case was registered under section 22 B (A) of the IPC. The action was based on a complaint filed by one Gireesh Babu, that Aju had violated the law by naming the woman survivor.
Aju Varghese was called in for questioning by the Kalamassery police on July 13. He was questioned from 11.30am till about 2pm.
