Kochi: The Kerala High Court today stayed the closure order issued by the Chalakkudy Municipality Council against D Cinemaas, owned by actor Dileep at Chalakkudy. In its verdict, the HC said the theatre can function as usual.
Meanwhile, criticizing the Municipality Council, the court said the decision taken by the Council to close the cinemas was illegal. The HC said that the Municipality’s order did not specify valid reasons that may lead to the closure of D Cinemaas, and added that the theatre is functioning with all legal permissions.
According to the court, there was no violation of conditions specified while issuing the licence or any other types of violations.
The court explained that the Municipality Council does not have any right to take steps to shut the theatre. Only the Secretary has the right to close an institution if it violates the rules.
Dileep’s brother Anoop had submitted a petition in the HC against the closure order issued by the Chalakkudy Municipality Council. According to his petition, the theatre had been functioning with a valid licence.
It may be recalled that the Municipality authorities and the Opposition together passed a resolution that recommended the closure of D Cinemaas as it had allegedly operated high HP motor for AC.
